I'm Spanish and living in the UK — do I need to file a UK tax return?
If you are UK tax resident and have untaxed income — self-employment, rental income, or investment income above the personal allowance — you need to file a Self Assessment with HMRC. If you're employed and all your income is taxed via PAYE, you may not. We'll tell you in a quick call whether you need to file.
Do I have to pay tax in both the UK and Spain on the same income?
Not if it's managed correctly. The UK–Spain Double Taxation Treaty prevents the same income being taxed twice. In practice, you pay tax in one country and claim relief in the other. How it works depends on your residency status and the type of income — which is exactly what we advise on.
Can I set up a UK limited company as a Spanish national?
Yes. There is no nationality or residency requirement to form a UK limited company. You can be a director and sole shareholder regardless of where you live. We handle the formation, Xero setup, and all ongoing compliance.
What is the Statutory Residence Test and does it affect me?
The Statutory Residence Test (SRT) determines whether you are UK resident for tax purposes in a given tax year. It matters because UK residents pay UK tax on worldwide income, while non-residents only pay on UK-source income. If you split your time between the UK and Spain, your residency status needs careful consideration.
I have a rental property in Spain — do I need to declare it in the UK?
If you are UK tax resident, you are required to declare worldwide income — including Spanish rental income — on your UK Self Assessment. The UK–Spain treaty and any Spanish tax already paid are taken into account to avoid double taxation, but the disclosure obligation in the UK still applies.
